Action Tours Djerba – Scooter Rental
1. Subject Matter of the Agreement
Action Tours Djerba rents out scooters, including a helmet, to the
renter for the agreed rental period.
By accepting the vehicle, the renter agrees to these Terms and Conditions.
2. Requirements for renting
The renter confirms:
·that they are at least 18 years old.
·that they hold a valid driver’s license for the rented vehicle.
·that they are physically and mentally capable of driving the vehicle safely.
·that they are not under the influence of alcohol, drugs, or medication.
Action Tours Djerba is entitled to refuse to hand over the vehicle if there are doubts
regarding the renter’s fitness to drive.
3. Vehicle Handover
The renter receives the vehicle in perfect working order.
A visual inspection is conducted jointly prior to handover.
Any pre-existing damage is documented.
Upon taking possession of the vehicle, the renter confirms that it is in proper working
order.
4. Use of the vehicle
The vehicle may only be used on the island of Djerba.
The following are not permitted:
·Driving outside the island of Djerba.
·Participating in races or competitions.
·Off-road driving, driving on the beach, or driving in restricted areas.
·Subletting or transferring the vehicle to third parties.
·Using the vehicle for commercial purposes.
The renter agrees to comply with all applicable traffic laws.
5. Tenant's Liability
The renter is liable for all damage occurring during the rental period due to:
·improper use,
·driving errors,
·gross negligence,
·intentional conduct,
·violation of traffic laws.
The renter is also liable for damage to rims, mirrors, body panels,
keys, and accessories.
6. Accident or theft
In the event of an accident, theft, or damage to the vehicle, the renter is required to:
1. Notify Action Tours Djerba immediately. We will come to you right away and assist with the process.
2. Refrain from admitting liability to third parties.
3. Provide all relevant information and documents.
In the event of theft, a police report must be submitted. We will accompany you to the police station.
7. Insurance
The vehicle is covered by the legally required liability insurance.
The liability insurance covers only damages to third parties within the scope of the statutory provisions.
Damages to the rental vehicle itself are the responsibility of the renter, unless otherwise agreed in writing.
8. Deductible in the event of a total loss or theft
In the event of a total loss or theft of the vehicle, the renter is liable up to an excess of 3,500,000 TND (approx. 1,100 EUR).
Scooters are equipped with anti-theft devices.
The liability limit does not apply in the event of:
·intentional conduct,
·gross negligence,
·driving without a valid driver’s license,
·driving under the influence of alcohol or drugs,
·violation of these Terms and Conditions.
9. Cancellation Policy
Reservations cancelled more than 24 hours before the rental start receive a full refund.
Cancellations within 24 hours before the rental start are non-refundable.
10. No-Show Policy
If the customer does not collect the scooter on the agreed date and time without prior notice, the reservation will be cancelled and no refund will be issued.
11. Force Majeure
Action Tours Djerba shall not be liable for any delay, interruption or cancellation
caused by circumstances beyond our reasonable control.
Force majeure includes, but is not limited to:
severe weather conditions,
natural disasters,
floods,
storms,
government restrictions,
road closures,
strikes,
civil unrest,
pandemics,
technical failures beyond our control,
or any other unforeseeable event.
If Action Tours Djerba cancels a booking due to force majeure, customers may
choose between:
a full refund, or
rebooking for another available date.
Action Tours Djerba shall not be liable for any additional costs incurred by the
customer, including accommodation, flights or other travel expenses.
Should any provision of these Terms and Conditions be or become invalid, all
remaining provisions shall remain unaffected.
Terms and Conditions (T&C)
Guided Quad Tours – Action Tours Djerba.
1.
Participation at your own risk
1.1 Participation in quad bike tours is at your own risk.
1.2 The participant confirms that he or she is aware of the risks associated with motorsports.
1.3 Action Tours Djerba is not liable for accidents, injuries, or damage resulting from the participant’s
own negligence, failure to follow instructions, or improper driving.
1.4 Action Tours Djerba reserves the right to exclude participants from the tour if they pose a danger
to themselves or others.
2. Eligibility Requirements
The participant confirms:
•that they are at least 16 years old and physically and mentally capable of operating a quad bike safely.
•that they are not under the influence of alcohol, drugs, or medication.
•that they have no health conditions that would prevent them from participating safely.
Pregnant women are expressly advised not to participate.
3. Safety Briefing
3.1 Before the tour begins, each participant will receive detailed safety instructions.
3.2 In addition, there will be a practical briefing followed by a test ride on the practice area.
3.3 Participants must follow the tour guide’s instructions at all times.
3.4 Failure to follow safety instructions may result in immediate removal from the tour. In such cases, no refund will be issued.
4. Clothing and protective gear
4.1 Wearing the provided safety helmet is mandatory.
4.2 Sturdy footwear is required.
4.3 Scarves, loose clothing, jewelry, open bags, or other items that could compromise safety are not permitted.
4.4 Personal protective equipment may be used provided it meets safety requirements.
5. Behavior During the Tour
5.1 Alcohol and drugs are strictly prohibited.
5.2 Risky driving maneuvers, passing the guide, racing, or intentional drifting are prohibited.
5.3 Participants must maintain a safe distance from other vehicles.
5.4 Departing from the designated route is not permitted.
5.5 Action Tours Djerba reserves the right to split up groups or exclude participants for safety reasons.
6. Liability for Damage to the Vehicle
6.1 The driver is liable for any damage to the ATV caused by his or her own fault.
This includes, in particular: Overturning of the vehicle, collisions, driving errors,
failure to follow safety instructions, and driving outside the designated route
6.2 Damaged vehicle parts, repair costs, and loss of use may be charged to the person responsible.
6.3 In the event of intentional or grossly negligent damage, the participant is liable for the full amount of the damage incurred.
7. Accidents
7.1 Any accident or damage must be reported to the tour guide immediately.
7.2 The participant agrees to cooperate in the investigation of the incident.
7.3 No admission of liability may be made to third parties.
8. Weather
8.1 Action Tours Djerba may postpone or cancel tours due to extreme weather conditions or for safety reasons.
8.2 In such cases, any payments already made will be refunded or credited toward an alternative date.
9. No Refunds
No refund will be issued in the following cases:
Failure of the participant to show up.
Late arrival.
Expulsion due to the influence of alcohol or drugs.
Expulsion due to failure to comply with safety rules.
Early departure from the tour by the participant.
10. Cancellation Policy
Cancellations made more than 24 hours before the scheduled tour start will receive
a full refund.
Cancellations made less than 24 hours before the scheduled tour are non-
refundable.
If the customer does not appear at the agreed meeting point without prior notice (No-
Show), 100% of the booking amount will be charged.
Refunds will be processed using the original payment method.
11. No-Show Policy
A booking is considered a No-Show if:
the customer does not arrive at the agreed meeting point,
arrives too late to participate,
or cannot participate due to missing legal requirements (e.g. driver's licence, alcohol
or drug influence).
In these cases no refund will be granted.
12. Force Majeure
Action Tours Djerba shall not be liable for any delay, interruption or cancellation
caused by circumstances beyond our reasonable control.
Force majeure includes, but is not limited to:

13. Photography and Videography
Photos and videos may be taken during the tour.
By participating, the participant agrees that these recordings may be used by Action Tours Djerba for promotional purposes.
The participant may object to this use in writing at any time.
14. Jurisdiction
The laws of the Republic of Tunisia shall apply exclusively.
The place of jurisdiction is Djerba, Tunisia.
15. Final Provisions
If any provision of these Terms and Conditions is or becomes invalid, the validity of
the remaining provisions shall remain unaffected.
